How to Start Homeschooling in Florida (2026)

Florida home education parents file a notice with the district school superintendent, keep a portfolio of records and materials, and file an annual educational evaluation under section 1002.41, Florida Statutes.

Legal framework

Section 1002.41, Florida Statutes, governs home education programs. The parent files a written notice, signed by the parent and listing the full legal names, addresses, and birthdates of all children enrolled, in the district school superintendent's office within 30 days of the establishment of the home education program. The parent maintains a portfolio of records and materials that includes a log of educational activities made contemporaneously with the instruction, designating by title any reading materials used, and samples of writings, worksheets, workbooks, or creative materials. The parent determines the content of the portfolio, preserves it for 2 years, and makes it available for inspection on request of the district school superintendent. The parent selects the method of annual educational evaluation and files a copy with the district school superintendent's office; the evaluation consists of one of the methods listed in the statute, the first of which is review of the portfolio and discussion with the student by a teacher holding a valid regular Florida certificate. The parent files a written notice of termination, with the annual evaluation, within 30 days of termination of the program.
