How to Start Homeschooling in Utah (2026)
Utah law requires the parent of a school-age child to enroll the child in a public or regularly established private school unless exempt, and a parent who withdraws a child to home school, or chooses not to enroll, gives the local school board a one-time initial notification (Utah Code 53G-6-202(2) and 53G-6-204(3)).
Legal framework
Utah Code Section 53G-6-202(2) provides that, except as provided in Section 53G-6-204 or 53G-6-702, the parent of a school-age child shall enroll and send the child to a public or regularly established private school. A school-age child is a minor who is at least six years old but younger than 18 years old and is not emancipated (53G-6-201). Section 53G-6-204(3) provides that when a parent withdraws an enrolled school-age child from school for the purpose of home-schooling, or chooses not to enroll a school-age child, the parent shall provide a one-time initial notification, which may include a letter of intent, to the local school board of the child's district of residence. A local school board may not require the notification if a parent of a school-age child provided a notification to the board on or before May 7, 2025, including through a home-school affidavit (53G-6-204(4)). The board keeps a record of the notification and acknowledges receipt to the parent within 30 days (53G-6-204(5)). The parent of a child who attends a home school is solely responsible for the selection of instructional materials and textbooks, the time, place, and method of instruction, and the evaluation of the instruction (53G-6-204(2)(a)). A local school board may not require a parent or legal guardian of a school-age child who attends a home school to maintain records of instruction or attendance, require credentials for individuals providing home school instruction, inspect home school facilities, or require standardized or other testing of home school students (53G-6-204(2)(b)).
